On November 28, 2023 Chemical Watch quoted Michael Boucher in an article titled, "Battery manufacturer, General Motors hit with $650k TSCA fine." The article discusses how General Motors Company and a vehicle battery manufacturer, Ultium Cells LLC, have agreed to pay a penalty of more than $650k for alleged violations of TSCA.
Speaking about the penalty Boucher said, "that MMOs are not new to TSCA, and are ‘abundant’ on the inventory.” The EPA issued its guidance, however, in recognition that some companies "were misunderstanding and misapplying" existing guidance and exemptions related to mixtures, which can generally be exempt from pre-market notification requirements if the components are all listed on the inventory. This resulted in some businesses "reaching the incorrect conclusion that their mixed metal oxides were treated as mixtures of their starting materials for TSCA purposes.”
