Communications Daily quoted Pantelis Michalopoulos in an October 16 article titled "Net Neutrality Remand Order Seen Ending Up in Court, Facing Recon Petition." The article reports that an expected 3-2 approval of the net neutrality remand order on October 27's Federal Communications Commission (FCC) agenda will likely be met by a reconsideration petition and/or legal challenge.
Michalopoulos, who represented clients in the Mozilla challenge of the net neutrality order, says the FCC has a problem in that not doing anything to change its prior decision risks the DC Circuit doing a broad review of the fundamentals of the net neutrality order itself, including Communications Act Title I reclassification.
