Overview
Law360 covered Steptoe's favorable outcome in the US Bankruptcy Court for the District of Delaware on behalf of former officers of Performance Sports Group Ltd (PSG). On June 30, Judge Brendan Shannon dismissed a breach of fiduciary duty action against those officers. The dismissal came after the claimant, the liquidating trustee, had taken extensive discovery.
In October 2019, former PSG officers, including Steptoe clients Mark Vendetti and Julie Zaleski, and the company's independent director filed an adversary complaint against the trustee for monetary, injunctive and declaratory relief in connection with threatened litigation by the trustee against the officers and directors. The trustee filed counterclaims, which the officers and directors moved to dismiss.
