Law360 covered Steptoe's win at the US International Trade Commission (ITC) for Inter Plas Industries SA in an article titled "ITC Halts Dumping Probe Of Mexican Thermoplastic Sheets." On September 18, Steptoe's International Trade practice secured a rare preliminary phase win before the ITC in an antidumping investigation on Polyethylene Terephthalate (PET) Sheet from Korea, Oman, and Mexico.
The Steptoe team, led by Pablo Bentes and Tom Trendl, and assisted by Marcia Pulcherio, was able to convince the ITC that Mexican imports were so negligible that they were unable to cause material injury to the US companies that brought the action. The task was made difficult by the highly imperfect data set, requiring the group to perform a complex analysis of both US import data and Mexican export data. As a result of the ITC's negative determination, the antidumping investigation has been terminated with respect to all Mexican producers, thereby allowing them to trade freely without having to go through an intensive and expensive government investigation and the potential addition of antidumping duties.
