On August 12, 2022, Law360 published an article by Tyler Evans titled "Preparing For Small Biz Subcontractor Evals After New Rules." The article discusses new rules requiring large contractors performing work for the US government to provide past-performance evaluations for their small business subcontractors. The rules, that go into effect on August 22, will require prime contractors with small business subcontracting plans to provide evaluations or risk being reported for noncompliance. It also covers considerations that both large contractors and small business subcontractors should keep in mind when preparing for the new framework.
Evans writes, "Failure to provide the evaluation will violate the prime contract's subcontracting plan and could result in termination of the prime contract for default, withholding of fees, poor past-performance ratings, liquidated damages, or, in extreme situations, suspension or debarment."
