Law360 quoted Pantelis Michalopoulos in a June 2 article titled “End Isn’t Nigh for FCC Rules on Local TV Station Deals.” The article discusses the Third Circuit striking down the Federal Communications Commission’s (FCC) limits on joint sales agreements among local TV stations.
Mr. Michalopoulos says: “I thought that the court’s decision was not that strong a reprimand of the FCC at all because what they said is that the expansion of the attribution standard to cover those agreements is to put the cart before the horse. All that the agency needs to do is reverse the order and put the horse before the cart and have the horse start pulling again.”
