Law360 quoted Teddy Baldwin in an April 18 article titled "Int'l Law Seen as Path to Fight Climate Change." The article discusses using investor-state dispute settlement to address environmental issues. Advocates say that such proceedings are likely not too far off, and that the critics of arbitration, such as nongovernmental organizations, might be doing themselves a disservice by refusing to recognize that potential.
Baldwin says: "They view it ... as a potential obstacle to good regulations, but as with anything there can be good and bad to it. Environmental groups and others should think about the benefit that can come to holding states responsible for climate change obligations and human rights obligations."
