Law.com International quoted Eléonore Mullier throughout a July 7 article titled "European Climate Law Heralds New Era for Companies and Their Legal Advisers." The article discusses how EU environmental regulatory and trade lawyers have stated that the new law enshrines climate ambitions and reduction targets into legislation for the first time.
Mullier comments that "the intention is for various sectors and industries to be asked to contribute to the reduction targets," adding that "all industries should expect to be impacted by the law, albeit by various degrees."
She also highlights how business should start monitoring the discussion. "Now is the time for companies, either directly or through their trade associations, obviously to get involved and participate in the discussion. Because they're the ones who know what measures they’ve already put in place, what kind of innovation is out there, what works, what doesn’t work for their sector, and it’s really important to feed that into the discussions that are starting to take place at the EU level."
Mullier concludes that "the European climate law itself should not give rise to a wave of climate lawsuits against private companies because it holds governments accountable. The Fit for 55 proposals, however, will likely prompt more legal action against companies from parties who feel they are not living up to the obligations spelled out in the package."
