Overview
Steptoe partner Michael Boucher was quoted in Chemical Watch's article, "TSCA Concerns Grow as US Shutdown Lingers," which examines the impact of the ongoing federal government shutdown on the US Environmental Protection Agency's (EPA) Toxic Substances Control Act (TSCA) program.
The article highlights uncertainty around how long the EPA's Office of Pollution Prevention and Toxics (OPPT) can continue operations under limited funding. Michael noted that the TSCA new and existing chemical programs "appeared to be operating more or less normally" so far, but he warned that OPPT may be "operating on a day-to-day basis" as reserve funds dwindle. He added that the shutdown could affect EPA's ability to take "major actions" on PFAS and may render many dates and deadlines in the Agency’s regulatory agenda "no longer either realistic or reliable."
