New York Attorney General Announces Stipulation Dissolving Trump Foundation: New York Attorney General Barbara Underwood announced that the Trump Foundation has signed a stipulation agreeing to dissolve under judicial supervision, with review and approval by the Attorney General of proposed recipient charities of the Foundation’s remaining assets. The lawsuit filed by the Attorney General’s office against the Foundation, which also seeks monetary damages in addition to a supervised dissolution, remains ongoing.
DC Circuit Holds FOIA Cannot Be Used to Obtain President’s Tax Returns: In Electronic Privacy Information Corp. v. Internal Revenue Service, No. 17-5225 (DC Cir. Dec. 18, 2018), the DC Circuit held that President Trump’s tax returns, and other return information that could reveal the nature or source of the President’s income, are exempt from disclosure by the Internal Revenue Service under the Freedom of Information Act because the confidentiality provisions of section 6103 bar their disclosure.
