Overview
Semafor quoted Chris Suarez in an article titled, "How Vibe Coding is Tipping Silicon Valley's Scales of Power." The article explores the rise of "vibe coding," a practice in which AI-powered tools perform many software development tasks. This phenomenon is reshaping Silicon Valley's startup ecosystem and democratizing app creation by enabling individuals, even those without technical expertise, to build applications simply by instructing large language models (LLMs).
Speaking to Semafor about how copyright law might be implicated when "vibe coding" and generative AI tools are used to develop software, Suarez said, "Copyright is about expression. If human expression is used to prompt the AI, there might be an argument, but it's going to be a lot harder to make that argument if you're relying on code straight-up generated by AI. The creativity comes in the actual writing of the code and how it’s organized, which humans don’t do when they prompt AI — no matter how creative the prompt itself is."
