The Disposal of Coal Combustion Residuals from Electric Utilities Final Rule (the Coal Ash Rule) is the first federal rule to regulate coal ash waste disposal. The Coal Ash Rule has proven controversial since it was first announced in 2015 and has given rise to regulatory changes, mass tort actions, and citizen suits under the Resource Conservation and Recovery Act (RCRA). The US Environmental Protection Agency recently announced that it is considering rolling back portions of the Coal Ash Rule. Growing controversies over the disposal of coal ash, the Coal Ash Rule, and the future of coal ash regulation are not likely to end soon.
