Overview
Kate Tellez is a trusted second-chair patent litigator known for her efficiency and quick-thinking. She advises clients and litigates cases across a variety of technical fields, including software-based inventions, pharmaceuticals, consumer goods, automotive parts, and medical devices.
Kate is an experienced trial attorney and effective cross-examiner comfortable in many forums. She has represented numerous clients in federal district courts and US Patent and Trademark Office proceedings, including inter partes reviews (IPRs), appeals before the Federal Circuit, and International Trade Commission investigations. She routinely handles complex litigation matters from inception through trial, including pre-suit counseling and strategy, case management, expert and fact discovery, witness preparation, dispositive motion practice, oral argument, and claim construction.
Her significant victories include securing a $40 million verdict where the jury found for her client on all issues at trial; obtaining a rare reversal at the Federal Circuit of an IPR determination of no anticipation; and securing a trial victory for a patent owner at the ITC that was upheld by the full commission.
She previously worked at a litigation funding firm.
