Overview
Nina MacLeay is a senior regulatory advisor in the Chemical, Environmental, and Life Sciences practice, advising clients on federal and state regulatory, compliance, and enforcement matters. Her work spans a broad range of regulated products and technologies, including chemicals, pesticides, consumer and commercial products, biological and microbial products, and products involving biotechnology and nanotechnology. She regularly helps clients navigate complex regulatory frameworks and manage risk across multiple jurisdictions.
Her practice encompasses all aspects of regulation, compliance, and enforcement under the federal Toxic Substances Control Act (TSCA) and its international counterparts; the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA); and related state laws, with an emphasis on California, including the Safe Drinking Water and Toxic Enforcement Act (Proposition 65). She advises FIFRA-regulated clients on pesticide registration, labeling, sale, and application requirements, including those administered by the California Department of Pesticide Regulation. Separately, she assists clients with Proposition 65 compliance matters, including failure-to-warn and discharge prohibition claims, product audits, compliance programs and training, and analysis of listing, labeling, and warning obligations.
She has conducted numerous voluntary compliance audits and guided clients through voluntary disclosures of noncompliance with federal and state chemical and pesticide laws. She also assists clients facing US Environmental Protection Agency (EPA) and state inspections and enforcement actions, handling both administrative and litigation matters. Her work emphasizes environmental compliance and due diligence, and she routinely advises manufacturers, distributors, and retailers on regulatory requirements affecting consumer products, industrial and specialty chemicals, biological and microbial products, and agricultural and non-agricultural pesticides. She has significant experience helping companies mitigate civil and criminal penalties and respond to subpoenas and information requests.
In addition, Nina provides regulatory due diligence in acquisitions and restructurings involving chemical and pesticide companies. Her work includes developing and implementing compliance management systems and supporting acquisition integration by evaluating and maintaining worldwide chemical notification and inventory obligations, as well as post-acquisition compliance support such as standard operating procedures, compliance programs, policies, and training materials.
