Overview
Robert Kappers is trusted by prominent companies to handle their complex patent and trade secret litigation matters from inception through trial. He is comfortable in court, having second-chaired several jury trials and successfully argued before district courts, the Patent Trial and Appeal Board, and the Federal Circuit. Most recently, he secured a $170 million verdict where the jury awarded the full damages sought and found wilful infringement, a $40 million verdict where the jury found for his client on all issues at trial, and reversed a $39 million judgment against his client on appeal.
Robert represents clients across a wide range of industries, including small molecule pharmaceuticals (Hatch-Waxman), medical device, and automotive industries. His recent work spans diverse therapeutic areas, such as ophthalmology, oncology, and diabetes, and spans diverse technologies, such as medical devices for use in cardiac and spinal surgery and to treat diabetes, tools to reduce noise, vibration, and harshness in automotive drivelines, and systems for website design and network communications.
As an adjunct professor, Robert teaches a course on "Patents and Intellectual Property: Business Applications" at the University of Cincinnati, College of Law. He is also an active member of professional and philanthropic organizations in Chicago, including the Richard Linn American Inn of Court and CARPLS, Cook County's largest provider of free legal services, for which he serves on the Professionals Board. He is also a member of the Auxiliary Board of the Chicago Council on Science and Technology (C2ST), whose mission is to enhance the public's understanding and appreciation of science and technology.
Robert graduated as Valedictorian from the University of Cincinnati College of Law, where he received many awards for his academic success, including the Lawrence Maxwell Memorial Advocacy Prize for excellence in advocacy.
Robert is a Registered Patent Attorney with the US Patent and Trademark Office.

Representative Matters
- Represented Express Mobile in a patent infringement case against GoDaddy.com related to foundational website design and development graphical user interface tools. After six years of litigation, including a successful appeal to the US Court of Appeals for the Federal Circuit, won a $170 million jury verdict, where the jury awarded the full damages sought.
- Represented Sandoz in patent infringement suit relating to pharmaceutical for growing eyelash hair. After years of litigation, upon appeal, won the reversal of $39 million in damages against our client.
- Representing Apotex in inter partes review relating to pharmaceutical for treating blood cancer.
- Representing Arvinas in trade secret misappropriation suit relating to targeted protein degraders for treating prostate and breast cancers.
- Represented Express Mobile in a patent infringement case against Shopify related to mobile phone and website functionality. Won a $40 million jury verdict, where the jury found all asserted claims at trial were infringed and valid.
- Representing Corrigent in several patent infringement suits relating to network switch and router technology.
- Represented American Axle & Manufacturing in patent infringement suit relating to automotive drive line noise and vibration technology. After a nine year battle, the case finally proceeded to trial where a jury delivered a verdict in favor of our client on all issues.
- Represented Sandoz in patent infringement suit relating to injection pen and pre-filled pharmaceutical for treating type-2 diabetes.
- Represented Sandoz in patent infringement suit relating to pharmaceutical for treating prostate cancer.
- Represented Rhodes Pharmaceuticals in patent infringement suit relating to pharmaceutical for treating of ADHD.
- Represented American Axle & Manufacturing in patent infringement suit and related inter partes review and Federal Circuit appeal relating to automotive driveline venting technology.
- Represented Honda in several inter partes reviews concerning patents to thermoplastic encapsulated electric motors.
