The Am Law Litigation Daily quoted Mike Miller in an article titled "With a Change in Administration Amid Economic Turmoil, Defense Lawyers See a Busy Future." The article, published January 6, provides comments from litigators on whether 2021 will see an uptick in litigation and government enforcement action.
Miller says he anticipates that the "tremendous volatility" we saw in the stock market last year will lead to a wave of criminal and regulatory insider trading cases. "The SEC and federal prosecutors have repeatedly warned that they are policing the stock markets for evidence that insiders are trading on material nonpublic information. And it is clear that prosecutors are also focused on profitable trading by individuals with access to market moving information held by the government," he says.
