Steptoe partners Anthony Hopp and Jeremy Goldkind, and associate David Cummings co-authored an article titled “Differential Diagnosis and Daubert: Preventing the Misuse of Differential Etiology to Prove Causation in Toxic Tort Cases” for the Defense Counsel Journal. The article, published in the January newsletter of the International Association of Defense Counsel, discusses “differential diagnosis,” a term often used by physicians, and how it has been used in toxic tort litigation to mean something completely different.
