On December 12, 2022 Global Competition Review quoted Lee Berger in an article titled, "FTC's "compelling" claims against Microsoft may lack support, experts say." The article discusses a complaint filed by the Federal Trade Commission alleging a $69 billion merger would incentivize Microsoft to withhold Activision Blizzard Inc.'s top games from other top-tier gaming consoles, violating Section 7 of the Sherman Act.
Speaking about the merger, Berger said, "the FTC is likely to be wary of Microsoft's proffered behavioural remedies given how tough they can be to enforce. In some ways, the merging companies' proposition is similar to the consent decree Live Nation and Ticketmaster entered into back in 2010, which was designed to prevent them from withholding concerts from music venues that refused to use Ticketmaster to sell tickets."
