Overview
Steptoe partner Guy Soussan was quoted in a Global Investigations Review article titled “EU Court to Consider Secret Evidence in Sanctions Cases.” The February 12 article looks at a change in the procedures of the EU General Court which will make it easier for the European Council and Commission to defend challenges to its sanctions.
Mr. Soussan explains that it is likely the new procedure stems from the Council being repeatedly “hammered” by European courts for not giving sanctioned entities a fair hearing. He adds that litigants who seek to annul their sanctions may try to challenge the General Court’s use of the secrecy procedure: “Litigants could start to focus on the merits of claiming confidentiality, which could slow these cases down.”
