Law360 quoted Jay Nuttall in a January 1 article discussing some of the patent litigation trends that will be followed closely in 2020. According to the article, lawyers expect a surge in patent suits in the new year as the institution rate at the Patent Trial and Appeal Board (PTAB) continues to drop.
Nuttall, co-chair of Steptoe's Intellectual Property Group, says, "With the PTAB invalidity rate leveling off, plaintiffs will be more willing to file cases [in district courts] and potentially run the gauntlet of getting through a PTAB procedure."
