Alan Cohn, Evan Abrams, Meegan Brooks, and Ryan Pereira have co-authored an article for The Licensing Journal titled "NFTs for Retailers: A World of Promise and Peril." The May 2022 article discusses the rapidly changing legal obstacles retailers face when minting and selling NFTs.
To retailers entering the NFT space, the authors note that companies "should carefully assess which regimes are likely to apply to their intended operations, and whether there is a way to design the project to avoid triggering the most burdensome obligations."
