Overview
Meredith Rathbone and Nicholas Kimbrell have authored an article for Export Compliance Manager titled "US forced labor law establishes new compliance paradigm." The July/August 2022 article discusses the introduction of the Uyghur Forced Labor Prevention Act (UFLPA) – with its hallmark "rebuttable presumption" regarding goods from the Xinjiang Uyghur Autonomous Region (XUAR). The passage of UFLPA followed years of interagency cooperation to combat alleged forced labor activities in XUAR and elsewhere.
The authors noted: "Companies that import from China into the United States – especially if goods have any connection to XUAR – should be on notice that their goods could be detained, excluded, and even seized under UFLPA; and that certain types of violations could result in civil or criminal penalties."
