In our motor carrier practice, we represent bus companies that transport passengers and trucking companies that transport property, including hazardous materials, with respect to all contract, commercial, regulatory, and enforcement matters.
We also practice extensively before the US Department of Transportation and its constituent units, including the Federal Motor Carrier Safety Administration (FMCSA), Federal Transit Administration (FTA), and National Highway Traffic Safety Administration (NHTSA). We also practice before the Surface Transportation Board (STB), an independent federal agency.
We are regularly involved in a broad range of federal regulatory issues pertaining to the transportation of property and persons by motor carrier, such as safety and security issues, emission limitations, new entrant audits, drug testing, speed limiters, mergers and acquisitions, and the development of federal and state policies for the operation of autonomous vehicles.
Our lawyers also advise clients with respect to cross-border transportation issues, including those arising under the North American Free Trade Agreement (NAFTA) and customs/immigration issues.
Representative Matters
- Advised major motor passenger carrier in variety of regulatory, legislative, and commercial matters concerning interstate bus transportation, including federal funding, reasonable access, and local zoning issues.
- Advised vehicle equipment manufacturers with respect to NHTSA safety reports and recalls.
- Advised bus company on federal pre-emption of state bridge weight limitations.
- Represented both sellers and buyers of motor carriers in merger and acquisition proceedings before the STB.
- Represented major bus company relative to state enforcement actions concerning bus emissions.
- Represented bus and trucking companies in response to investigations and enforcement actions initiated by the FMCSA.
- Advised bus company on successful award of federal grant monies for implementation of new bus technologies and facilities.
- Represented bus companies in bankruptcy proceedings relating to motor carrier operations, including resolving federal and state operating authority issues to allow continuation of bus operations.
- Advised bus companies with respect to multi-state enforcement actions relating to driver and bus safety violations.
