Eric Emerson is a partner in the Washington office of Steptoe & Johnson LLP, where he is a member of the International Department. He has practiced there since 1991, focusing principally on the regulation of international trade.
International Trade Litigation
Mr. Emerson's principal area of practice is in the field of antidumping and countervailing duty proceedings before the US Department of Commerce and the US International Trade Commission. In these matters, he has represented both domestic and foreign companies in cases covering a wide variety of imports, including capital equipment, furniture, uranium, magnesium, shrimp, and various steel products. His work has included cases conducted under the special provisions of the antidumping duty law applicable to non-market economies. In addition to representing numerous US companies, Mr. Emerson has worked with clients located in Japan, China, Korea, Thailand, Canada, Trinidad and Tobago, the United Kingdom, and the Netherlands.
Several of the cases in which Mr. Emerson has been involved have resulted in appeals to the Court of International Trade and the Court of Appeals for the Federal Circuit, and Mr. Emerson has presented arguments before both courts. Mr. Emerson was also involved in one of the earliest appeals before a bi-national panel convened under the Canada-US Trade Agreement.
In addition to representing companies actively involved in trade litigation, Mr. Emerson spends considerable time counseling clients on ways to avoid or reduce the risk of such litigation. This aspect of his practice includes helping clients develop pricing strategies to minimize the risk of making unfairly priced sales in the United States, while still remaining competitive in the market.
International Trade Policy & Strategy
Mr. Emerson counsels US and foreign clients on various aspects of trade policy, and on the ways in which trade disputes fit into a broader US policy perspective. For example, for many years, Mr. Emerson has counseled a US company with interests in a trade agreement involving imports of uranium products from the Russian Federation, an agreement that involves US trade policy issues, but also US national security and US energy policy concerns as well. Mr. Emerson also counsels clients on their rights and obligations under the World Trade Organization agreements.
Customs
Mr. Emerson represents clients in proceedings before US Customs and Border Protection (Customs). These representations have included obtaining ruling requests on issues of classification and valuation, protesting erroneous action by Customs, and advising clients being audited by Customs.
Mr. Emerson has also participated in the firm’s export control and immigration practices.
Prior to entering law school, Mr. Emerson worked as a Legislative Assistant to the late Senator Paul Simon, with responsibility for international trade and manufacturing issues.
