President Trump has ordered the Department of Justice to investigate private sector companies, federal contractors, financial assistance recipients, universities, large nonprofits, and bar and medical associations for employing DEI programs. Enforcement is anticipated to center on anti-discrimination and antitrust statutes, and could give rise to follow-on state attorneys general investigations, False Claims Act lawsuits, and private class actions.
Even if you had previously confirmed the lawfulness of your DEI program under relevant federal laws and contracting requirements, the President’s DEI Executive Order requires a fresh risk assessment.
