Daniel F. Gelwicks

Dan Gelwicks focuses his practice on patent litigation, trade secret disputes, and other intellectual property and technology-related matters. He represents clients in federal district courts and before the US Court of Appeals for the Federal Circuit, and he also has experience in post-grant proceedings before the Patent Trial and Appeal Board.

Dan leverages his technical background and litigation experience to represent companies with innovative pharmaceutical, biotechnology, medical device, electrical, mechanical, software, aerospace, communications, networking, semiconductor, alternative energy, robotics, and consumer product technologies.

Dan has served on numerous biotechnology, Hatch-Waxman, and high-tech engineering trial teams. He has experience across all phases of litigation, including fact and expert discovery, claim construction, dispositive motion practice, examining fact and expert witnesses at trial, taking and defending fact and expert depositions, managing teams of lawyers during discovery and pretrial preparation, and preparing cases for trial and appeal.

Apart from litigation, Dan advises clients on patent counseling, patent prosecution, portfolio management, freedom-to-operate issues, enforcement strategy, and related intellectual property matters. His counseling experience spans companies at all stages, from innovative start-ups to well-established corporations with global footprints.

Dan also works with colleagues across the firm on intellectual property and technology issues that arise in broader commercial litigation, investigations, transactions, financing matters, and government contracts representations. Clients and colleagues turn to him when patent, trade secret, software, data, or other proprietary technology issues intersect with broader business, regulatory, or technical challenges requiring practical, business-oriented advice.

Prior to practicing law, Dan managed and worked alongside cross-disciplinary teams that designed engineering systems and conducted corresponding field verification in the oil refining, chemical processing, and food and beverage processing industries.
