Overview
Garrett Kays advises clients on international trade and trade remedy matters, leveraging deep government experience from the US Department of Commerce's Office of the Chief Counsel for Trade Enforcement and Compliance office. He assists companies in navigating antidumping (AD) and countervailing (CVD) duty proceedings, managing cross-border compliance risk, and developing practical strategies for complex agency investigations and resulting litigation.
Garrett has extensive experience analyzing and defending AD and CVD determinations, providing legal guidance in numerous investigations and administrative reviews involving a broad range of countries and industries. His work has involved interpreting and applying complex trade statutes and regulations, reviewing legal memoranda and Federal Register notices, and assessing the legal defensibility of agency determinations.
He has drafted numerous briefs, motions, and other written submissions defending AD and CVD determinations of the Department of Commerce in litigation before the US Court of International Trade, USMCA binational panels, and the US Court of Appeals for the Federal Circuit. Garrett also has experience contributing to the development of new trade regulations and participating in the resolution of World Trade Organization disputes.
Before attending law school, Garrett worked in trade policy and legislative roles, including at the Office of the US Trade Representative and on Capitol Hill, where he advised and supported policy decision makers. This experience enables him to provide clients with valuable insight into the policy objectives and analytical frameworks that shape international trade enforcement from the government’s perspective.
