Partner Andrew Adams and associate Daniel Podair authored an article that appeared in Lawfare titled: "Confusion & Contradiction in the UN 'Cybercrime' Convention." The article addresses the significant concerns raised by cybersecurity, privacy, and human rights experts regarding the proposed United Nations "Cybercrime" Convention, and notes tension that this multilateral agreement would insert into other US diplomatic and law enforcement relationships. It highlights that the Draft Convention lacks meaningful human rights safeguards and could be easily abused to target political dissidents and journalists under broadly defined cybercrimes. The adoption of the convention could undermine the United States' ability to resist problematic legal requests from authoritarian governments and complicate existing mutual legal assistance treaties.
