Overview
Investigations by the DOJ and other agencies cover a wide swath of conduct, but often share one thing in common: They don't stop at the border. Counterintuitively, when evidence is located abroad, prosecutors are often afforded more time than in purely domestic investigations due to tolling of the statute of limitations under 18 U.S.C. § 3292.
In an article for Bloomberg titled, "Defenses to Tolling Applications Under 18 U.S.C. § 3292," Patrick Linehan, Galen Kast, and Meredith Lewis analyze why this happens and how defendants (and defense counsel) can defend against the tolling § 3292 permits.
