Overview
Steptoe and its co-counsel secured a major victory for client ExxonMobil before the US Supreme Court in Exxon Mobil Corp. v. Corporación Cimex S.A. (Cuba), et al. Steptoe first brought this case in the United States District Court for the District of Columbia in 2019. The win was covered by Law360 in an article titled "Justices Clear Path For Exxon Damages Claim In Cuba Case."
On June 23, the Court found that a federal law allowing US victims of property seizures by the Cuban government to seek damages itself abrogates the sovereign immunity of state-owned entities targeted in such cases. The 6-3 opinion authored by Justice Brett Kavanaugh removes an important barrier for Exxon Mobil Corp.'s lawsuit for some $1 billion in damages against certain Cuban state-owned instrumentalities.
