Matthew Coleman and Thomas Innes have published an article titled "Provisional Measures During Suspension of ICSID Proceedings" in the ICSID Review. The article deals with the powers of an ICSID tribunal to order provisional measures during a period where proceedings are suspended when a vacancy arises on an ICSID tribunal, and also when a proposal to disqualify an arbitrator is made. This is a unique but potentially very significant situation. Although the subject is complex and in some respects unclear, the authors’ conclusion is that such a power does indeed exist.
