(April 3, 2025, Washington, DC) — Steptoe obtained a significant win before the US Court of Appeals for the Federal Circuit on behalf of our client, Express Mobile, Inc. In Express Mobile's patent infringement case against GoDaddy.com, the Federal Circuit vacated the district court’s summary judgment of non-infringement of two patents that serve as the foundation of modern web-design.
Express Mobile filed suit against GoDaddy.com in 2019, alleging infringement of U.S. Patent No. 6,546,397 and No. 7,594,168, which claim priority to an application filed in 1999 and are foundational to modern web-design. The district court narrowly construed the claim term, "runtime engine," and then entered summary judgment of non-infringement based on that narrow claim construction.
The Federal Circuit Court of Appeals agreed with Express Mobile's argument on appeal relating to the construction of the term runtime engine, reversed the district court’s claim construction, and vacated the district court's summary judgment of non-infringement. The Federal Circuit therefore remanded the case to the district court for further proceedings. This is a significant win for Express Mobile and Express Mobile looks forward to presenting its case to a jury.
