Law360 quoted Pantelis Michalopoulos in an article titled "Pai Tests Waters on Leaving Net Neutrality to Providers." The article, published April 12, discusses why news that Federal Communications Commission Chairman Ajit Pai is considering stripping net neutrality rules to instead seek voluntary commitments has set off a firestorm. Experts say it's unclear how he would ensure open Internet principles apply long-term across providers.
Mr. Michalopoulos, who represented intervenors in the net neutrality case at the DC Circuit, says presumably there would still need to be some kind of backstop if an Internet service provider (ISP) refused to make a voluntary commitment. "I think it sounds easier than it will turn out to be because the devil will be in the details." In his words, "the very idea of a voluntary commitment raises a question of what would be in place if that voluntary commitment is not voluntarily made."
