Doug Green is a partner in the Washington office of Steptoe & Johnson LLP. He handles major matters in the fields of electric power, antitrust, and commercial litigation.
Mr. Green has been lead counsel in antitrust, business torts, civil RICO, constructing breach of contract, and other litigation matters involving billions of dollars. He regularly counsels major energy companies on antitrust compliance and affiliate relationships. In the regulatory arena, he has successfully tried cases before federal and state regulatory agencies involving a number of the major competition and restructuring cases in the industry, and various other matters.
Mr. Green is listed as a Tier One lawyer by the peer-reviewed Chambers Guide and is recognized in Best Lawyers in America, and has appeared in Who’s Who in American Law. The Chambers Guide (2009) has referred to him as “the definitive antitrust energy litigator.”
Representative Matters
- Obtained dismissal on the merits, on behalf of Edison Mission Marketing & Trading, of antitrust class action lawsuits alleging billions of dollars in damages from collusion in the Illinois power auction.
- Represented Southern California Edison Company and obtained favorable settlement of litigation brought by the Navajo Nation alleging fraud, RICO violations, and business torts concerning the coal royalty rates for the Mohave Generating Station, and seeking over a billion dollars in damages.
- Successfully represented companies in numerous Department of Justice Antitrust Division investigations involving, inter alia, mergers and acquisitions, alleged refusals to provide transmission service, tolling agreements, electric vehicles, capacity markets, and electric energy markets.
- Won favorable decisions after lengthy trial proceedings concerning the AEP-CSW merger, the NU-PSNH merger, and the Entergy-Gulf States merger.
- Obtained payment of $131 million for Public Service Electric & Gas in suit involving the maloperation of the Peach Bottom nuclear power plant.
- As co-counsel with a Texas law firm, obtained a $750 million settlement from Halliburton and Brown and Root in a lawsuit concerning the design and construction of the South Texas Nuclear Plant.
- Won dismissal of efforts by plaintiff to certify class in lawsuit brought vs. major chemical company alleging contamination of water supply in two towns in New Jersey.
- Obtained favorable verdict from FERC and the DC Circuit that Entergy did not have to pay $40 million in claimed refunds despite violation of its tariffs.
- Defended Houston Lighting & Power Company in DOJ antitrust action brought at the NRC for refusal to interconnect.
- Obtained, with co-counsel, summary judgment of claims seeking hundreds of millions of dollars of damages against major electric utility for alleged monopolization of nuclear power in Florida.
- Represented major electric power companies in regulatory forums in nuclear prudence cases.
- Represented defendant Topps Chewing Gum Co. in trial concerning alleged monopolization of baseball trading cards, with damages claims defeated at trial and liability claims rejected on appeal.
