Overview
David Kahne is an accomplished commercial litigator, with a varied complex commercial litigation practice handling all aspects of civil litigation in federal and state court and in investigations before federal and state regulatory agencies. He has extensive experience representing both plaintiffs and defendants in all phases of litigation beginning with the commencement of an action, discovery and continuing through appellate briefing and argument, where he has authored briefs in the Second Circuit Court of Appeals and the Supreme Court of the United States.
In the area of public sector labor relations, David has advised some of New York’s largest public unions in negotiation, arbitration, and litigation in a variety of areas. David’s experience includes defending the contract, employment, pension and constitutional rights of some of New York City and Long Island’s largest public employee unions in both state and federal court. He has been involved in various collective bargaining-related matters, including binding and non-binding contract arbitration pursuant to the Taylor Law and related court proceedings. David has been recognized as a "rising star" in the area of labor as part of City & State’s "Labor 40 under 40."
David has successfully advised individuals, financial institutions, and trading firms in complex commercial disputes and investigations related to physical commodities, related derivative products and securities. David has handled contract, fraud, unfair competition, insolvency and other business tort litigations. He also has represented banks, trading firms and other private companies in large class actions, and in investigations before the US Commodity Futures Trading Commission, US Department of Justice Civil Division, and the US Securities and Exchange Commission.

Representative Matters
- Represented one of the country’s largest public sector union in challenging the constitutionality of a New Hampshire "CRT" law that banned the teaching of certain concepts in the classroom.
- Represents administrators in community based-publicly funded early education programs who are predominantly women of color in seeking pay parity with their less diverse district counterparts.
- Represented one of the City’s largest municipals union in contract arbitrations and related mediation and administrative proceedings.
- Represented commercial landlords in a Contracts Clause challenge to New York City’s "guaranty law," which invalidated the "good guy" guaranty clause in commercial leases during the COVID-19 pandemic.
- Represented a large Long Island union in a Contracts Clause challenge to a County-imposed wage freeze on all municipal workers.
- Regularly represents large commodities traders and institutional trading clients in proceedings before the CME, CFTC, and SEC.
- Represented physical commodity refineries in complex commercial disputes in both state and federal court.
