Overview
Law360 quoted Zoe Osborne in an article titled, "Vacuum Or Trap? What Trump's FCPA Halt Means For SFO." The article discusses how U.S. President Donald Trump's decision to stop enforcing bribery laws against American companies creates a potential vacuum for the Serious Fraud Office (SFO) to fill, though lawyers caution that prosecuting U.S. companies could prove a political hazard for the U.K. enforcement agency.
Speaking to Law360 about the important role of the U.S. in international investigations Osborne said: "It of course shouldn't stop the U.K. authorities from prosecuting bribery offenses under the Bribery Act, but so many of the SFO's cases rely on the fruits of FCPA enforcement actions. I also wonder from a public policy point of view whether the U.K. will be comfortable prosecuting U.S. companies for breaching the Bribery Act, which means that the U.K. would be left prosecuting non-U.S. companies."
