Companies increasingly push to incorporate environmental, social, and governance (ESG) activities into their business models. Though ESG programs may yield tangible business advantages, increased scrutiny from regulators, investors, and consumers also pose substantial legal and reputational risks to companies.
In an article for the Winter 2022 issue The In-House Lawyer, Alex Melia, Zoe Osborne, and John Rupp detail the ESG risks that companies might face and provide practical steps for in-house counsel to identify and mitigate these risks. Of particular importance is the need to minimize the gap between what is said and what is actually done, with regards to a company's ESG efforts.
