Overview
Sally Mordi counsels major railroad industry clients on regulatory matters. She regularly represents railroads in proceedings before the Surface Transportation Board (STB). Sally advises clients on obtaining STB regulatory approval for a variety of transactions, including mergers, acquisitions, and the abandonment or discontinuance of service over rail lines. She also advises clients on participating in STB proceedings where other parties are seeking such licenses. Additionally, Sally assists clients with navigating environmental issues in STB proceedings.
Sally also advises clients on environmental and chemical regulatory matters. She assists clients with compliance and enforcement issues under a variety of federal and state statutes, including the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA); the Toxic Substances Control Act (TSCA); the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA); and the Resource Conservation and Recovery Act (RCRA).

Representative Matters
- Assisted with representing a Class I railroad in obtaining STB approval in a control and merger proceeding classified by the STB as "significant."
- Advised a Class I railroad on obtaining STB approval in multiple abandonment proceedings and on resolving environmental conditions imposed by the STB.
- Advised a packaging company on implications of per- and polyfluoroalkyl substances (PFAS) contamination in fluorinated containers.
- Assisted negotiating a settlement to resolve a US Environmental Protection Agency (EPA) enforcement matter under TSCA.
- Advised a health tech company on responding to an EPA information request under FIFRA related to pesticide devices.
