Overview
Conor Tucker is a litigator. He has served clients as lead counsel at all levels of the federal court system, including as Counsel of Record in the United States Supreme Court. Conor has managed cases through every stage of litigation, from pre-complaint investigation through trial and appeal, and argued dispositive motions and appeals in state and federal courts. His written and oral advocacy has led to published, precedent-setting opinions, including on issues of first impression. Conor has experience litigating on a wide range of issues, including contract, trademark, trade secret, copyright, patent, constitutional criminal procedure, due process rights, and civil procedure for clients in a wide range of industries, including technology, energy, real estate, apparel, entertainment, banking, healthcare, social media, and computer sciences.
During law school, Conor won the Raul Berger Prize for his research on the jurisdictional aspects of the Defend Trade Secrets Act. He writes a quarterly column on developments in trade secret law for New Matter, the publication of the California Lawyer’s Association’s IP section. He regularly publishes and presents on diverse topics, from civil procedure to trademark and the First Amendment.

Representative Matters
- Led briefing and argued appeal for Hulu in the California Court of Appeal, resulting in a victory and published opinion in favor of client on an issue of first impression in California telecommunications law. Lancaster v. Netflix and Hulu (2024).
- Represented indigent criminal defendant in petition for certiorari regarding the scope of statutory habeas corpus jurisdiction.
- Represented video streaming companies (including Hulu and Disney+) in appeals stemming from municipal assertions of state telecommunications statutes, including in the supreme courts of Missouri and Indiana, the state courts of appeals in California, Texas, Indiana, and Missouri, and the U.S. Court of Appeals for the Seventh Circuit.
- Represented Hulu and Disney+ and led supplemental briefing ordered after oral argument regarding diversity jurisdiction under the Class Action Fairness Act—an issue of first impression in the Seventh Circuit. City of East St. Louis v. Netflix et al., 83 F.4th 1066 (7th Cir. 2023).
- Lead briefing for William Morris Endeavor Entertainment, resulting in published opinion in favor of client on an issue of first impression regarding force majeure provisions in performance contracts during the COVID-19 crisis. VFLA Eventco v. WME (2024).
- Represented indigent criminal defendant regarding Sixth Amendment impartial jury rights in a petition for certiorari which received SCOTUSBlog’s Petition of the Week accolade.
- Counsel for beer, wine, and spirit industry groups as amici curiae in the U.S. Supreme Court in connection with Jack Daniel’s v. VIP Products (No. 22-148).
- Counsel of Record in the U.S. Supreme Court for Robyn Bradshaw, grandmother and adoptive parent of child at center of the consolidated cases Haaland et al. v. Brackeen et al.
- Won reversal by Seventh Circuit of district court’s dismissal of a prisoner’s civil rights action alleging Eighth Amendment violations in Balle v. Kennedy et al., 73 F.4th 545 (7th Cir. 2023).
- Represented Google and won affirmance by the California Court of Appeal in Attia et al. v. Google LLC.
- Argued appeal before Ninth Circuit in Munoz-Ventura v. Barr(2020).
- Represented Skechers, Inc., in investigation in remand proceedings and review of such proceedings in the International Trade Commission.
- Represented Skechers, Inc., and led briefing on dispositive motion on issue of first impression in litigation regarding claimed trade dress in the midsole design of Chuck Taylor All Star sneakers in Converse, Inc., v. Skechers U.S.A., Inc. (E.D.N.Y.)
- Represented Skechers in multiple intersecting design and utility patent infringement lawsuits involving athletic shoes in Nike, Inc. v. Skechers U.S.A., Inc.(C.D. Cal.)
- Represented trademark owner in complex litigation in multiple fora in Under Armour, Inc. v. Kelsey Battle(D. Md., E.D.N.C., 4th Cir.)
