Overview
Emma Marshak is an experienced litigator whose practice focuses on judgment enforcement and complex commercial litigation in federal and state court. She regularly handles matters involving contract claims, fraud, class actions, covenants not to compete, and government investigations in addition to her domestic and international judgment enforcement work at every stage from complaint drafting to trial.
Her recent work has included leading a team of associates representing the operator of a crude-by-rail transloading facility pursuing fraudulent transfer claims arising from breach of a take-or-pay contract in a four-week bench trial and extensive post-trial briefing, and serving as the senior associate on a team that secured a first-of-its-kind reverse veil-piercing ruling in Delaware Chancery Court for SourceHOV Holdings LLC, which led to the collection of a nearly $58 million-plus-interest merger stock appraisal award.
Emma maintains an active pro bono practice. She recently obtained asylum for an Afghan woman who escaped Kabul during Operation Allies Refuge, and has pursued civil rights claims in Arkansas and Maryland. She also represented domestic violence victims in DC Superior Court.
