Overview
Heather Hildreth is an intellectual property litigator who focuses her practice on patent litigation and trade secret disputes, representing clients in high‑stakes technology matters across federal and state courts and before the Patent Trial and Appeal Board (PTAB). She also has experience litigating and advising on copyright and contract matters. Heather has experience handling all phases of IP litigation, including pre‑litigation strategic counseling, due diligence investigations, expert and fact discovery, deposition preparation, dispositive motion practice, claim construction, trial preparation, and appeals.
In addition to her litigation practice, Heather gained experience earlier in her career in patent preparation, prosecution, and counseling, which gives her a strategic advantage when evaluating patent validity, infringement positions, and enforcement risks. During law school, she worked as a patent agent and student associate, where she advised companies on developing and managing high‑value patent portfolios aligned with long‑term business goals, including drafting and managing claim sets and patent families designed to strategically target competitor products. As a litigator, Heather continues to help companies develop and refine claims with an offensive enforcement posture in mind, coordinating with in-house and/or outside prosecution counsel. Her prosecution experience also provides deep familiarity with patent‑eligibility and claim‑scope arguments under §§101 and 112, which she leverages in both offensive and defensive contexts. Heather’s prosecution experience allows her to bridge prosecution and litigation strategy, ensuring that claim scope and litigation strategies account for potential competitors and future assertion goals.
Heather's background is in physics, which has provided a strong foundation for working across a broad spectrum of technologies, including software and machine learning, mechanical devices, image processing, electronics, medical devices, semiconductors, automotive technologies, and consumer products.
