Overview
Chris Fredrich focuses his practice on complex civil litigation, with an emphasis in defending financial institutions and other commercial clients in class actions, arbitration, and enforcement matters.
As a litigator, Chris represents banks, digital payment companies, credit card issuers, loan servicers, investors, and technology companies in state and federal court proceedings, at both the trial and appellate levels. He has significant experience litigating claims under banking, privacy and consumer protection laws, including the Electronic Fund Transfer Act, Truth in Lending Act, Fair Credit Reporting Act, Fair Debt Collection Practices Act and Telephone Consumer Protection Act, as well as California’s Unfair Competition Law, False Advertising Law, Consumers Legal Remedies Act and Invasion of Privacy Act. Chris has successfully defended multiple actions alleging violations of the Uniform Commercial Code and state-law contract and tort theories.
Chris also has significant experience advising clients in regulatory and compliance matters. This includes conducting comprehensive internal procedure reviews, assessing risk in connection with institutional investment opportunities, and counseling clients on privacy and data breach notification issues. In addition, Chris represents clients in responding to state and federal regulator inquiries and enforcement actions.

Representative Matters
Litigation & Arbitration
- Representing various financial institutions in consumer class and individual actions alleging violations of the Electronic Fund Transfer Act and its implementing regulation, Regulation E.
- First-chair representation of a national bank through final arbitration hearing, resulting in a complete defense award in the bank's favor and defeating claimant's claims for alleged violations of the Fair Credit Billing Act and California's Rosenthal Fair Debt Collection Practices Act and Song-Beverly Credit Card Act.
- Coordinated a national bank’s defense of over 40 individual actions and multiple putative class actions in state and federal courts arising from loan servicing and non-judicial foreclosure practices.
- Successfully compelled arbitration on behalf of a national bank in a putative class action under California’s Unfair Competition Law and Consumers Legal Remedies Act related to debit card practices, defeating claims that the relief sought was “public injunctive relief.”
- Represented a commercial real estate investment company in a breach of contract action related to tax obligations for changes in ownership of a flagship retail location.
- Defended multiple national banks in wire fraud actions related to the purchase of cryptocurrencies.
- Defended a trustee of residential mortgage-backed securities in a federal action and appeal concerning the novel issue of whether a promissory note with a negative amortization provision is a “negotiable instrument” under the UCC.
Financial Regulatory Compliance & Policy
- Represented banks and financial services companies in connection with inquiries and enforcement actions brought by federal and state regulators and law enforcement, including the Consumer Financial Protection Bureau, Federal Trade Commission, Office of the Comptroller of the Currency and state attorneys general.
- Advised various clients in developing compliance programs and defense strategies in response to state privacy laws, including the California Consumer Privacy Act.
- Counseled an automotive finance company in a national data breach response, including developing notice to impacted customers.
- Counseled a national bank in review of policies and procedures for the management and disposition of real estate owned (REO) properties, including compliance with the Fair Housing Act and Equal Credit Opportunity Act.
