Overview
Dennis Raglin has over 25 years of experience counseling and defending clients in California's Proposition 65 right-to-know chemical warnings law and is co-chair of Steptoe's Prop 65 group. He is a tenacious litigator who has represented clients in bet-the-company cases. Dennis was trial counsel in one of the few Prop 65 cases to ever be tried to verdict in the law's 37-year history – representing a national food manufacturer. He was also part of the team achieving victory at the California Court of Appeals establishing federal law preempts Prop 65 warnings for generic over-the-counter medication. He has also secured favorable settlements for national clients in high-profile Prop 65 suits brought by the state Attorney General. His practice includes knowledge of, and counseling on, a broad range of other state and federal chemical laws and regulations, including those related to foods and the FDA, PFAS, personal and children’s products, TSCA and CPSIA, packaging and recycling, and green chemistry initiatives.
Dennis works with companies large and small to understand these laws and fashion the most effective outcome, whether it be a strengthened compliance program, resolution and settlement, or through litigation - always with an eye toward what works and what gets the best results. Dennis partners with his clients to understand their business and then works together to achieve their goals.
Dennis also defends clients in products liability matters, with a focus on medical devices and pharmaceuticals. He is currently California counsel for a national medical device manufacturer. His diverse experience has encompassed defending products such as implantable and prescription medical devices, prescription and over-the-counter pharmaceuticals, biologics, baby and toddler formula and nutritional supplements. .
Dennis has been both a speaker and an author of numerous articles in his fields of practice. He has spoken to various companies and trade groups on best practices for compliance with Prop 65 and regulations in California and other states related to green chemistry, PFAS chemicals, and consumer product chemical reporting obligations, all issues of increasing importance with states across the country enacting more regulations in these areas. He has also written numerous articles on the constitutionality of Prop 65, including on the issue of federal preemption. In the area of medical and pharmaceutical products, he has presented and written on topics related to FDA regulation of nutritional supplements, best practices in complying with FDA guidance governing device and pharmaceutical companies’ social media policies, and scientific information exchange.

- Part of team achieving 2023 victory where appeals court affirmed federal law preempts Proposition 65 warnings on over-the-counter generic medications – Center for Environmental Health v. Perrigo Co., et al. 89 Cal.App.5th 1
- Represent international food conglomerate in Proposition 65 case involving arsenic and lead in 11 spice products, a case with significant importance to spice manufacturers worldwide.
- Negotiated with state Attorney General favorable judgment resolving years-long Proposition 65 claim involving presence of lead in manufacturer's baby and toddler formulas.
- Negotiated favorable settlement on behalf of international online marketplace regarding Proposition 65 compliance for consumer products sold on its site by merchants.
- Secured dismissal of Proposition 65 case alleging violation by national manufacturer and retailers regarding levels of cadmium in over-the-counter antacids.
- Secured dismissal involving the chemicals lead and DEHP exposure in various consumer products after developing dispositive expert and testing showing chemicals were present in levels below the amount triggering warnings.
- Convinced private enforcer to abandon case against national food manufacturer involving acrylamide in children's food based on federal preemption.
- Represent international supplement maker in claim of excessive heavy metals in health food products.

- Counsel one of world's top rice manufacturers in Proposition 65 compliance.
- Counsel tool company trade association on best practices for supply chain and vendor certification to ensure members' compliance with Proposition 65 and state and federal chemical reporting regulations.
- Advising ceramic and glass trade group on federal and state chemical regulations impacting industry.
- Provide advice to multiple food manufacturers on latest California law and provide assessment and recommendations on changes in supply chain and vendor agreements to enhance protections against claims.
- Reviewed and advised online marketplace on establishing compliance program addressing California chemical law and Proposition 65, including assisting with educating merchants and revision of its merchant agreement.
Medical Device and Pharmaceutical Products Liability
- Serve as California counsel for national medical device manufacturer and have defended several types of products from power wheelchairs to hospital beds to oxygen machines.
- Currently representing medical device manufacturer in case involving injury to paraplegic from using wheelchair.
- Secured defense verdict involving client's cautery device used in child's failed tonsillectomy.
- Achieved dismissal of wrongful death case involving use of client's oxygen concentrator.
- Achieved summary judgment in case involving wrongful death of woman falling from transfer sling.
- Argued and won multiple summary judgments involving medical device client’s metallic implants.
- Part of trial team representing international medical device company regarding claims of failure to warn and injury from its artificial hips.
- Part of team representing pharmaceutical company in Multi District Litigations involving thousands of plaintiffs involving multiple prescription medications.
