Representative Matters
- Representing a Chinese client in its successful appeal against a US$345 million freezing order granted by the English High Court in support of proceedings in the United States. The Court of Appeal decision is now a key authority on the unambiguous impropriety exception to without prejudice privilege.
- Subsequently representing that Chinese client in long-running judgment enforcement proceedings. The representation included successful applications for a stay of the proceedings generally pending the claimants’ compliance with outstanding costs orders, a stay of execution of a judgment pending the outcome of a US appeal as well as the revocation of that judgment following the outcome of the US appeal. The proceedings culminated in the dismissal of the judgment creditor’s remaining claims at trial.
- Representing a cryptocurrency exchange in a €144 million wrongful termination of contract claim.
- Representing a cryptocurrency exchange in an appeal arising out of collective proceedings before the CAT in which the class representative seeks damages of approximately £9 billion.
- Representing a Hong Kong company in its attempts to enforce in England a Russian judgment worth approximately £14 million against a debtor already declared bankrupt in Russia. The proceedings raised novel cross-border insolvency issues and have included to date a security for costs application, a jurisdiction challenge, a freezing order application and an application for disclosure ancillary to the freezing order.
- Acting in an LCIA arbitration to recover approximately €27 million owed under a series of parent company guarantees.
- Representing a client in fraud proceedings before the English Court involving the recovery of a sum of cryptocurrency valued at around £1.6 million, which involved a successful application for what is thought to be one of the first freezing orders in England in respect of cryptocurrency.
