Overview
Brittney L. Denley focuses her practice on white-collar defense and investigations, higher education, and commercial litigation. Brittney has represented clients across industries during all stages of litigation, and in regulatory enforcement actions and investigations by the Department of Justice, Securities and Exchange Commission, and Department of Education. Clients have sought her assistance addressing claims arising under the Foreign Corrupt Practices Act (FCPA), False Claims Act (FCA), Trafficking Victims Protection Act (TVPA) among others. She has also advised individuals and institutions in navigating wage and hour disputes, responding to identity-based discrimination claims, and developing workplace protocols.
Before entering private practice, Brittney was the Associate Director of Equal Opportunity and Affirmative Action/Title IX at Vassar College. She draws upon this experience to provide informed counsel to our Education clients on a wide variety matters including regulatory and enforcement inquiries, internal investigations and compliance reviews, and disputes in litigation. Notably, Brittney has advised institutions on navigating domestic and international data privacy regulations, and addressing claims arising under state and federal law (including Titles VI, VII, IX, the Clery Act, FERPA, New York State Education Law Article 129-B). She has guided clients on developing and implementing institutional protocols to address student and employee misconduct, navigate campus free speech concerns, administer disability services and accommodations, respond to health and safety guidance concerning COVID-19, and improve effectiveness of institutional safety, security and, law enforcement functions. Finally, Brittney has developed and facilitated tailored trainings for college and university stakeholders on DEIB in faculty recruitment and retention, best practices for implementing effective campus climate surveys, and the prohibition and legal implications of campus hazing, among others.
