Overview
Shaun Boedicker's practice focuses on a wide-range of litigation and regulatory matters for energy companies before the Federal Energy Regulatory Commission (FERC), as well as in state and federal courts. He regularly represents clients in highly complex and contentious disputes, including claims of alleged market manipulation, monopolization, violations of state tort law, and others. He has particular experience in applying preemption and related doctrines to suits brought against his clients. Shaun also counsels clients concerning all facets of federal energy regulation, frequently serving as the primary counsel on behalf of his clients for filings and other actions taken before FERC. He has represented clients in dozens of complaints and other actions brought before FERC worth hundreds of millions of dollars. Shaun has also been counsel in nearly a dozen federal appeals challenging FERC actions.

Representative Matters
- Argued at the D.C. Circuit Court of Appeals representing electric utility challenging FERC orders on the allocation of revenue sufficiency guarantee payments within an RTO.
- Represented pipeline company in district court and on appeal in novel Carmack Amendment claim case where all causes of actions were dismissed under the filed rate doctrine.
- Represented electric utility in monopolization lawsuit seeking nearly $3 billion in damages that was dismissed on summary judgment.
- Represented electric utility in state court litigation responding to allegations of negligence, and secured voluntary dismissal with prejudice following briefing after arguing that plaintiffs’ claims were barred under the doctrines of preemption and the filed rate doctrine.
- Represented numerous electric utilities in litigated complaint matters before FERC concerning cost-of-service and other rate disputes.
- Represented independent generator in FERC investigation into alleged market manipulation and alleged violations of ISO tariff.
