Overview
Jarod Stewart is chair of Steptoe's Commercial Litigation Group. He is a seasoned litigator and trial lawyer who gets the details right; is responsive; and out-briefs, out-prepares, and out-works the opposition to succeed in litigation and at trial. Jarod has represented plaintiffs and defendants in a wide variety of matters, including business divorces, trade secrets disputes, healthcare litigation, fraudulent-transfer lawsuits, oil and gas disputes, and transnational cases involving Latin America.
Jarod primarily focuses his practice on helping clients in the energy and healthcare industries. He has gone toe-to-toe with outstanding lawyers from across the United States and has won significant victories for his clients in court, arbitration, and administrative proceedings. Clients praise his ability to produce outstanding work product quickly, and to help them navigate thorny legal issues whenever and wherever he is needed.

Representative Matters
Energy Industry
- Successfully represented trustee of bankrupt oil and gas company to recover tens of millions of dollars in fraudulent transfers from dozens of defendants, including by obtaining summary judgment on the "good faith" defense in a ruling that was upheld by the US Fifth Circuit Court of Appeals.
- Obtained declaratory judgment for oil and gas company declaring it the owner of disputed oil and gas assets and interests located throughout Texas, Louisiana, and Arkansas, a judgment unanimously affirmed on appeal.
- Obtained summary judgment for oil and gas company in AAA arbitration, with the arbitrator ruling that client did not owe a duty to indemnify another energy company in connection with environmental liabilities in Louisiana.
- Defended multiple energy companies against claims for misappropriation of trade secrets and tortious interference, successfully defeating claims and obtaining favorable outcomes and resolutions.
- Defeated energy company’s request for a temporary injunction that would have prohibited its former employees from working for a competitor.
- Represented global energy company to pursue misappropriation of trade secrets claims against its primary competitor.
- Obtained a temporary restraining order and temporary injunction in favor of an oil field equipment manufacturer against its former employees who left to form a competitor.
- Secured a temporary restraining order for a Top 25 oil and gas producer to stop collection on a judgment.
- After years of hard-fought litigation and shortly before trial, obtained favorable settlement for Latin American power generation company in a multimillion-dollar negligence and breach-of-contract suit against a large international equipment transporter.
- Negotiated favorable settlement for oil field services company in suit against international equipment manufacturer concerning millions of dollars of defective oil field equipment.
- On the eve of trial, achieved multimillion-dollar settlement for commercial transporter of crude oil in lawsuit against global energy company.
Health Care Industry
- Represented hospital system in numerous managed care and commercial disputes.
- Defeated request for temporary restraining order against hospital in highly-publicized negligence lawsuit.
- Successfully represented hospital in final arbitration hearing against national insurance company involving millions of dollars in disputed health care claims.
- Obtained favorable settlement for hospital system in suit against national insurance company for systematic failure to pay for tens of millions of dollars in health care claims.
- Obtained summary judgment for health care clients in a suit filed by a national insurance company seeking $14.5 million in damages based on alleged fraudulent billing, a ruling that was unanimously affirmed on appeal.
- On behalf of two physicians being sued by their former colleagues, obtained unanimous ruling from the Texas First Court of Appeals ordering the plaintiffs' claims to be resolved in arbitration.
- On behalf of hospital system sued for medical malpractice and wrongful death, won dismissal of all claims but one and subsequently resolved the case favorably for the client.
- Represented hospital system in two breach of contract and fraud cases against national insurance companies, where the hospital system alleged tens of millions of dollars of systematic underpayments; obtained favorable settlements in both cases.
- Defended health care provider in False Claims Act case alleging that false claims were submitted in connection with medical equipment used in certain procedures.
Labor and Employment
- Defended business owner/executive against claims by former management team seeking additional bonus and an equity position following a nine-figure sale of the business.
- Defended business at trial against claims by former employee seeking additional bonus.
Construction
- Represented general contractor in arbitration to resolve dispute over construction of commercial building, including claims for change orders and delays; obtained favorable settlement for client.
- Representing general contractor in multi-party lawsuit involving project owner and subcontractor alleging non-payment for construction services rendered in connection with remediation and repair following damage caused by Winter Storm Uri.
- Represented contractor in lawsuit over construction of gas pipeline facilities alleging claims for extra work and delay damages; matter settled favorably.
Class Action/MDL
- Represented hospital system in defending against several putative class actions, none of which has been certified as a class.
- Obtained summary judgment for hospital to defeat putative class action challenging hospital's emergency room billing and charges.
Other
- Represented commercial real estate developer at trial and on appeal in business divorce dispute involving eight-figure claims for fraud and breach of fiduciary duty, which resulted in a take-nothing judgment.
- Defended clients against claims of fraud, civil RICO, and conspiracy in multi-year, multi-party, multi-jurisdictional dispute.
- Obtained take-nothing jury verdict on behalf of nonprofit organization sued for alleged fraud and return of charitable contributions.
- Obtained summary judgment, affirmed by the US Fifth Circuit Court of Appeals, dismissing federal and state trademark infringement claims brought against client.
