Overview
Henry J. Caldwell represents individuals and corporations throughout a diverse range of industries in various litigation matters in both state and federal court. Henry has represented chemicals, environmental, healthcare, retail, manufacturing, energy, and technology clients in all phases of complex commercial litigation, with a focus on drafting pleadings and dispositive motions, efficiently managing all aspects of written, document, and oral discovery, and preparing for trial.
Henry has represented numerous companies in individual and class action litigation. He has experience representing medical device manufacturers, health care services corporations, and energy and petrochemical companies in defending products and toxic tort claims. Henry also has experience representing a variety of clients involved in class action litigation under state and federal data privacy and consumer protection statutes. In particular, he has counseled clients on compliance and litigation matters involving the Illinois Biometric Information Privacy Act (BIPA) and the Fair and Accurate Credit Transactions Act (FACTA).
Henry has experience in all stages of individual and class action litigation, and has a keen interest in assisting clients as they navigate complex commercial disputes, including the attendant business, reputational, and legal risks.

Representative Matters
- Defending manufacturer of industrial chemical products in numerous class action, state and municipal action, and personal injury lawsuits arising from alleged potable water and natural resource impact.
- Defending infant formula manufacturing client in federal multi-district and state consolidated mass tort product liability litigation. Plaintiffs have asserted claims for strict products liability, negligence, breach of warranty, and alleged violation of state consumer protection laws.
- Represented consumer product manufacturing client in state products liability lawsuit alleging product defect and breach of warranty claims and successfully achieved voluntary dismissal with prejudice after close of fact discovery. Responsibilities included managing written and oral discovery (including several depositions of fact and expert witnesses), supervising preparation of expert report, and drafting discovery and dispositive motions.
- Represented pharmaceutical client involved in state consolidated mass tort product liability litigation related to generic and brand name pharmaceutical products.
- Represented pharmaceutical client in responding to third-party discovery subpoenas in federal lawsuit involving civil racketeering and breach of contract allegations.
- Represented hospital client in breach of contract litigation involving consulting services that resulted in favorable settlement following close of fact discovery. Participated in taking and defending numerous depositions, including of corporate representatives and experts, and additionally supervised fact and expert discovery, preparation of expert report, drafting and arguing discovery motions, and drafting dispositive motions.
- Represented a variety of food, manufacturing, healthcare, and technology clients in defending class actions brought under Illinois Biometric Information Privacy Act. Managed internal investigation to assess compliance risks, supervised written fact discovery, and participated in discovery and dispositive motion practice.
- Represented parking system manufacturer in third-party breach of contract and contribution action relating to underlying class action brought pursuant to Fair and Accurate Credit Transaction Act. Supervised written fact discovery and took depositions of class representatives.
