Steptoe’s success for Lexington Insurance Co. in a commercial insurance-coverage action involving claims by CML Metals Corporation (CML) was covered by Law360 and Mealey’s Litigation Reports.
On August 11, Judge Tina Campbell of the US District Court for the District of Utah granted partial summary judgment to Lexington with respect to multiple coverage claims by CML, effectively reducing CML’s claims from more than $36 million dollars to less than $1 million. CML sought coverage under a Lexington builders risk policy, alleging physical damage to an iron ore concentrate plant CML constructed in Iron County, Utah.
