Fiduciary Exception to Privilege in Law Firm Communications Upheld

Steptoe attorneys Justin Chu and Leah Quadrino co-authored an article titled “Fiduciary Exception to Privilege in Law Firm Communications Upheld” for the New York Law Journal.  The article, published on January 16, explores whether communications between a law firm’s in-house counsel and its attorneys are privileged.  The article was written in reaction to a recent New York State Supreme Court decision that held that these communications are fair game for discovery if a firm’s client sues for malpractice.  The decision breaks with a nationwide trend among state courts that largely uphold the privilege in similar circumstances.
